CONDITION OF SALE
All products sold by American Car Products, Inc. are sold as-is, unless the product is covered under warranty. Actual product may look slightly different from the photos. All products sold or distributed by American Car Products, Inc. are subject to a 25 percent cancellation fee. Any items that are claimed under warranty can be sent back if the reason falls under what the limited warranty covers for the particular product. Any products shipped back must be shipped and paid for by the buyer.
CONTINGENCIES
Seller shall not be liable for any failures to produce product to buyer when the cause of such failure is the result of forces of nature, labor dispute, supplies of material shortage. Acts of local state, national, civil, or other authorities or public agencies. Utility or communication failures, accidents, strikes, transportation problems, or any act or cause that does not normally occur in the ordinary course of seller(s) business.
PAYMENT
All orders must be prepaid by cashiers check, certified personal check, money order, or credit card (Visa/ Mastercard/ Amex/ Discover). No COD in any form will be allowed. Company checks are accepted upon American Car Products, Inc. credit approval application. Prepayment made by regular company check will be held until it clears before merchandise can be shipped. International shipments must be prepaid in US dollars. Returned checks will be charged with a 45.00 returned check fee (each time) and the company written the check will be liable for three times the value of the check written.
RETURNS
Authorization to return product(s) must be obtained from American Car Products, Inc. in advance and must be made within 5 (five) days of receipt of merchandise. A return RMA form must be signed in order to validate your return. Pictures for defective parts must also be received within 5 days of receipt of merchandise. Failure to do so may forfeit your privilege to return/exchange the products. All cancelled orders are subject to a 25 percent (twenty-five percent) cancellation fee. There is no restocking fee for returns or exchanges made within 5 days of receipt and in original packaging. If you are not satisfied with our products for any reason simply send the products back in original packaging within 5 days to obtain an exchange or a full refund of the products purchased price. Shipping fees are not refundable and paid for by the buyer. Products altered in any way may not be returned or exchanged unless permitted by the Seller. All products that are approved for return after 5 days are for store credit only and may incur a 25 percent cancellation/restocking fee. All products returned must be in the same condition as it was originally delivered by the seller to buyer. Special or custom-made orders are not refundable. All electrical or mechanical parts are non-returnable. Merchandise signed for is assumed delivered and no shortage claims will be considered unless noted on delivery ticket at time of delivery. Damaged-shipped merchandise must claim with the freight carrier. Original receipt must be presented for credit or exchange. NO RECEIPT NO REFUND. Exchanges on poor fitment of body kits will only be given after careful review and inspection. Pictures of the fitment or part will be requested in most cases. No returns on any parts that have been used, installed, modified, or disassembled. All returns must be sent to Seller freight prepaid and insured by Buyer. No refund or credit on labor or freight charges. Buyer is responsible for all shipping costs. Any refused shipment sent back to American Car Products, Inc. does not constitute the right to any refund credit. American Car Products, Inc. will forfeit all deposits for any merchandise that is not picked up after 60 days from the original invoice date and invoice will be deemed null and void.
INTERNET ORDERING POLICY
All electronic and internet orders placed through this site could take up to 48 hours to process through American Car Products, Inc. shipping department. This will affect ground and air shipments. We strive to process your order as expediently as possible, and most orders are processed the next business day, after we receive the electronic transmission, but due to internet congestion and ISP server errors, sometimes the electronic transmission takes up to 72 hours to transmit. American Car Products, Inc. is not responsible for delays in ground shipping by the freight carrier that we might choose to use.
SHIPPING DAMAGE
American Car Products, Inc. packs all merchandise carefully to prevent damage during shipments. Nevertheless, damage may occur occasionally in transit. Any damage in shipment is the responsibility of the carrier, therefore all damage claims must be made by the purchaser directly to the carrier. All products shipped by American Car Products, Inc. are insured for their full value. In case of damage retain all cartons, packing materials and damaged merchandise for the carrier to inspect. Never refuse shipment or return it without approval since your right to make a damage claim may be denied. Always remember to personally inspect all packages prior to signing acceptance of shipment. Failure to do so can hold you liable for damages. If the damage is apparent upon receipt, do not accept the merchandise and note the damage and irregularities (such as crushed, torn or broken packing) to the freight driver and have the driver sign it as verification. If the damage is not readily apparent at the time of arrival (where the box is intact but the merchandise inside is damaged), then it must be reported to the shipping company within 24 hours after receipt of shipment. After inspecting the damaged merchandise, the carrier will determine whether to pay for repair costs or replacement value of the damaged goods. Replacement value is not negotiable. It is the amount that you paid for. Repair cost is an arbitrary amount that can be negotiated with the carrier in the event of disagreement. All disputes as to the settlement amount or manner should be addressed with the carrier. American Car Products, Inc. under no circumstance shall be liable for the damaged merchandise or for subsequent settlement of the claim with the carrier. However, as a courtesy, we would be glad to help you in reaching an amicable settlement with the carrier in the event that you need assistance.
WARRANTY/LIABILITY
Seller(s) sole warranty for each product sold is set forth in the warranty documentation associated with the product. Seller gives no warranties, express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Seller will not be held liable for any damages that are incurred directly or indirectly on the vehicles or operators or passengers of the vehicle. |
